The three clean years, counted properly
The condition that decides most cases, and the one people get wrong by a year.

Article 20/D is open to someone who had no Turkish domicile and no Turkish tax liability in each of the three calendar years before becoming a Turkish tax resident. Calendar years, not rolling twelve-month periods. That distinction decides cases.
A worked example
You move in March 2027 and become tax resident in 2027. The years examined are 2024, 2025 and 2026. A single month of Turkish employment income in, say, August 2024 puts that whole year out, and with it the exemption.
Leave in 2024 and come back in 2027 and you are short. The count wants the three full years before the year you become resident.
What does not count against you
Earlier Turkish rent, dividends, interest or capital gains are harmless. Those are the kinds of income a non-resident can have in Turkey without being taxed as a resident, and the condition is written around residence rather than around any contact with Turkey.
Turkish wages or business income in those years are a different matter. Those point to having been taxed in Turkey, which is precisely what the condition excludes.
Returning Turks
Nationality is not a condition anywhere in the article. A Turkish citizen who lived abroad for the last three calendar years qualifies on the same terms as anyone else. This surprises people, including some Turkish citizens who assumed the rule was written for foreigners.
If you are close
When the three years are borderline, the honest answer is usually to delay the move rather than to argue. The condition is objective and the tax office checks it before issuing the certificate. Arriving a year later with a clean count beats arriving on time and being refused.
